Federal Government Threatens Kansas School District Funding Amid Transgender Student Policy Dispute

The Trump administration announced Tuesday its intention to pursue enforcement actions against Kansas City, Kansas Public Schools, potentially including the withholding of federal funding. This move stems from the administration's assertion that the district's policies prevent staff from informing parents about a transgender student's gender identity.
According to the Education Department, Kansas City, Kansas Public Schools' guidelines, which advise against disclosing a student's transgender status to their parents, constitute a violation of the Family Educational Rights and Privacy Act (FERPA).
The department confirmed it is collaborating with the Justice Department to implement "appropriate enforcement measures." These actions could involve judicial proceedings and the potential cessation of federal financial support for the district.
"Kansas City Kansas Public Schools' sustained efforts to sidestep FERPA, conceal its true policies, and obstruct parents’ lawful access to their children’s education records represents a serious and deliberate breach of federal law," stated Frank Miller, Director of the Student Privacy Policy Office at the Education Department. "A strong and coordinated enforcement partnership between the Department of Education and the Department of Justice will ensure districts are held accountable and fully honor parents’ rights."
The federal government highlighted that the district's policy explicitly states school personnel "should not disclose information that may reveal a student’s transgender status or gender nonconforming presentation to others, including parents."
The Education Department further noted that despite presenting a "proposed Resolution Agreement" outlining specific remedies for the FERPA violations, the district has reportedly continued to disregard federal parental rights legislation.
Broader Federal Stance on Transgender Policies
This action against Kansas City, Kansas Public Schools is not isolated. The administration has previously threatened to withdraw federal funding from several other school districts nationwide over their policies concerning transgender students.
Earlier in the year, the Education Department had identified policies in four Kansas school districts, including Kansas City, Kansas Public Schools, as being in contravention of federal law regarding transgender students.
In a related development, President Donald Trump recently issued an executive order aimed at prohibiting transgender women and girls from participating in girls’ and women’s sports. Concurrently, the U.S. Supreme Court issued a ruling on Tuesday affirming states' authority to implement such bans, specifically upholding laws in Idaho and West Virginia. However, the ruling did not impose a requirement for states without these prohibitions to adopt them.
