Attorney General Todd Blanche has expressed strong approval for the Justice Department's recent $400 million settlement with TikTok, which addresses allegations of privacy violations concerning children. Blanche characterized the resolution as a "fair, just and right result" during a recent appearance. He emphasized that the agreement not only addresses TikTok's past conduct but also reinforces efforts to safeguard young individuals using online platforms.
Blanche issued a clear warning to other entities:
If companies and entities are not doing what they're supposed to do to make sure that happens, we're [going to] come after them.
Justice Department Reaches Significant Settlement
The Department of Justice officially announced the comprehensive agreement on Friday. The settlement involves TikTok, its parent company ByteDance, and associated entities agreeing to remit $400 million to resolve ongoing litigation. This legal action centered on compliance with the Children’s Online Privacy Protection Act (COPPA).
Commitment to Online Child Safety
The lawsuit was initially filed under the Biden administration in 2024. Blanche highlighted that TikTok has undergone substantial organizational shifts since the commencement of the legal proceedings. He noted that the settlement acknowledges these corporate changes, which he views as an appropriate consideration.
Since that lawsuit was filed, as folks know, TikTok has undergone a meaningful change in ownership, leadership, management and their practices. And, so, this lawsuit and the settlement of it takes into account the changes the company has made since the lawsuit was filed, which is exactly what we should be doing.
He reiterated the government's firm stance on child protection, declaring:
It's a stark reminder and a real important note to anybody out there that we are [going to] protect children, and the internet has got to be a safe place for children.
TikTok's Operational Changes Noted
According to the Justice Department, TikTok has implemented several new measures designed to enhance the protection of its younger user base. These include the introduction of age-related controls and strengthened parental oversight functionalities.
DOJ officials affirmed in a statement that, "Those developments have materially advanced the public interests underlying the Department's litigation and have strengthened protections for millions of American families."
Financial Details of the Agreement
Blanche conveyed his satisfaction with the financial aspect of the settlement, referring to it as a "big number." He commented:
It's a lot of money that they agreed to pay to kind of address what happened in the past to make sure it doesn't happen in the future.
The settlement mandates an immediate payment of $300 million from TikTok and ByteDance. An additional $100 million will be paid upon the issuance of an order that vacates a previous consent decree imposed against Musical.ly, TikTok’s predecessor application.
